iMDsoft, which provides cutting-edge systems for intensive care units under its trademark MetaVision, filed papers with the Patent Office to force a determination of who was the first to invent the technology. Visicu Inc. granted a patent on Oct. 12 for certain remote ICU monitoring, has been contacting iMDsoft customers, claiming full rights to all remote ICU technology and offering to help those medical facilities remove their iMDsoft systems. The company sent similar letters to potential iMDsoft customers as well. "Visicu is overstepping its rights by overstating what its patent covers," says Phyllis Gotlib, CEO of iMDsoft. Moreover the patent rightfully belongs to iMDsoft. iMDsoft is confident that the U.S. Patent Office will not only uphold its claim to have invented the technology, but also award iMDsoft all of the claims in the recently issued Visicu patent". iMDsoft first applied for a patent on ICU monitoring systems in 1996. It has since filed additional patent applications, specifically including one for using such technology for remote monitoring. "It is clear that iMDsoft was the first to invent," says attorney Mark Lappin of McDermott Will & Emery, noting that all of its relevant applications share the 1996 filing date. Visicu did not file its application until 1999. iMDsoft is not alone in taking action against Visicu. In response to similar letters, healthcare information technology giant Cerner Corporation has filed suit in federal court, seeking a judicial declaration that Cerner is not infringing on the Visicu patent. Remote ICU monitoring is a fast growing business in the United States. Hospitals now use these high-tech systems to allow intensive care specialists in off-site centers to track every change in patient condition. iMDsoft, a major provider of these systems in Europe and Japan, recently entered the US market, and already has MetaVision systems installed at a number of US hospitals. The iMDsoft products, marketed under trademark MetaVision, not only allow remote monitoring of ICU's from off-site centers, but are also used for monitoring from on-site locations and from physicians' offices. iMDsoft's Metavision's products are also used for monitoring in operating room environments.
